29-11-2021 Heard learned counsel for the parties.
The petitioner seeks bail in Khaira P.S. Case No. 204 of 2019, registered for the offence under Sections 341, 323, 307 & 34 of the Indian Penal Code.
As per the prosecution case, the petitioner is alleged to have assaulted the informant by means of stick and when mother of informant tried to save him (informant), this petitioner gave spade blow over head of his mother, as a result of which, she sustained lacerated wound on her head, which has been found to be grievous in nature by the doctor. It is submitted on behalf of petitioner that there is case & counter case and both sides sustained injury. Both parties are gotiyas and due to dispute over a piece of land, the scuffle took place between them. The injured is none else but own aunt (Qqvk) of the petitioner and petitioner is in custody since 07.06.2021.
Patna High Court CR. MISC. No.51069 of 2021(2) dt.29-11-2021 2/2 Learned A.P.P. for the State has opposed the bail petition.
Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jamui in connection with Khaira P.S.
