The petitioner apprehends his arrest in a case registered for the offence under Section 504, 341, 506, 302/34 of the Indian Penal Code.

As per the prosecution case, on 07.04.2021 at about 9:30 PM, while the informant and his family members were sitting on the door, petitioner alongwith other three co-accused came there and started abusing, which was objected, then coaccused Braj Kishore Singh and Rahul Kumar caught hold brother of the informant and thereafter, co-accused Golu Kumar fired from his pistol, which hit brother of informant, as a result of which, he fell down and died.

Patna High Court CR. MISC. No.50942 of 2021(3) dt.21-06-2022 2/2 It is submitted on behalf of petitioner that there is no specific allegation of overt act against this petitioner. There is general and omnibus allegation. Petitioner has got clean antecedent.

However, learned counsel for informant vehemently opposes the prayer for anticipatory bail of petitioner and submits that petitioner was also instrumental in the occurrence. Considering the aforesaid facts and circumstances as well as clean antecedent of petitioner, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bailbond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., East Champaran at Motihari in connection with Turkauliya P.S. Case No. 296 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Prabhat Kumar Singh, J) anay/- U T
