JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 10-08-2015 The petitioner is a resident of Gaya under Magadh division. He seeks quashing of the minimum per dismal value of land fixed under Rules 6(2) of the Bihar Stamp (Prevention of Under-Valuation of Instruments) (Amendment) Rule, 2006 issued under the signature of District Sub Registrar, Registration, Gaya for the year 2011-12 (Annexure 1). The petitioner, while referring to paragraph 7 of the writ petition, submits that by the impugned order, the minimum per dismal value of land has been enhanced six times from earlier rates as in earlier preceding five years the enhancement never were six times. He has also raised a grievance before the Appellate authority (the Commissioner, Magdh Division). Having regard to the facts and circumstances of the case, if the petitioner files a fresh appeal/representation before the

Patna High Court CWJC No.20758 of 2011 (3) dt.10-08-2015 appellate authority, it is expected that the same would be disposed of within a period of four months of its filing. In case, any application for condonation of delay is filed, the appellate authority would be sympathetic enough to condone the same as the petitioner was pursuing remedy before this Court.
