JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 13-07-2017 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in Nasriganj P.S. Case No. 183 of 2016 registered under Sections 379 and 411 of the Indian Penal Code.

Two she buffaloes of the informant are said to have been stolen by Gulam Rasul and Kapil Mansuri who were seen taking the same from the house of one Akhtar Mansuri. It is submitted by learned counsel for the petitioner that the petitioner is neither named in the F.I.R. nor any incriminating article has been recovered from his conscious physical possession. His name has surfaced in this case on the basis of the confessional statement of the co-accused, namely,

Patna High Court Cr.Misc. No.32412 of 2017 (2) dt.13-07-2017 2/2 Dhanji Ram which has no evidentiary value in the eye of law. He has been languishing in custody since 03.01.2017. Co-accused Dhanji Ram has been enlarged on bail by a co-ordinate bench of this curt vide order dated 25.04.2017 passed in Cr. Misc. No. 18481 of 2017.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Bikramganj, Rohtas in connection with Nasriganj P.S. Case No. 183 of 2016.
