Mr. Rita Verma ====================================================== CORAM: HONOURABLE MR. JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 25-08-2025 Heard learned counsel for the petitioner and learned A.P.P for the State.

2. The petitioner has preferred this application for grant of regular bail in connection with Gopalganj (Mahila) P.S. Case No. 16/2025 dated 09.04.2025 registered for the offences punishable u/ss 143(1), 145, 98 read with section 3(5) of the BNS, sections 4, 8, 12 of the POCSO Act, sections 3, 4, 5, 6 of the Immoral Traffic (Prevention) Act and sections 16, 17, 18 of the Bonded Labour System (Abolition) Act.

3. As per the prosecution case, the petitioner and the co-accused persons are alleged to have brought the minor girls from different states by luring them with money. It is further alleged that the accused persons were indulged in buying and

No.39574 of 2025(3) dt.25-08-2025 2/3 selling of the minor girls for the purpose of illegal work and also made them hostage for doing immoral activities during the Orchestra program and it is further alleged that some female dancers were also recovered from the premises of the petitioner.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The victims in their statement recorded u/s 183 of the BNSS have not stated even the name of the petitioner and they also stated that nothing wrong were done with them. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 11.04.2025.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Gopalganj in connection with Gopalganj (Mahila) P.S. Case No. 16/2025, with the condition/s:- (i). The petitioner is directed to remain physically present before the learned Court below on each and every date,

Patna High Court CR. MISC. No.39574 of 2025(3) dt.25-08-2025 3/3 failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled.
