This is the second attempt of the petitioner for grant of regular bail in connection with Naubatpur P.S. Case No. 156 of 2014, a case under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.
Allegation against the petitioner is that he slit the throat of Chhotan Nonia.
This Court while refusing the prayer for bail of the petitioner, who is in custody since 19.04.2016, directed the trial court to expedite the trial by order dated 24.01.2017 passed in Cr. Misc. No. 48877 of 2016.
The report of the learned Sessions Judge at flag B dated 07.11.2017 would reveal that the case of the petitioner has
Patna High Court Cr.Misc. No.35814 of 2017 (4) dt.08-11-2017 2/2 been committed to the Court of Sessions on 09.10.2017. Considering the period already undergone by the petitioner, let the petitioner, above named, be released on bail, only after framing of the charge in the case, on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Naubatpur P.S. Case No. 156 of 2014, subject to the condition that the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner. With the aforesaid observation, this application stands disposed of.
