JUSTICE DINESH KUMAR SINGH ORAL ORDER 17-09-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147, 149, 341, 323, 325, 504, 506, 307 and 379 of the Indian Penal Code. The prosecution case is that the FIR named accused persons surrounded the informant when co-accused Ranveer Kumar and Babloo Yadav assaulted with iron rod causing injury on the head of the informant when co-accused Anil Yadav snatched `10,000/- from the pocket of the informant. It is alleged against these petitioners that they assaulted the informant with fists and slaps and also pressed his neck leading to the unconsciousness of the informant.

No.37279 of 2015 (2) dt.17-09-2015 2/2 It is submitted by learned counsel for the petitioners that the specific accusation of assault on the head of the informant is against co-accused Ranveer Kumar and Babloo Yadav. The petitioners alleged to have assaulted with fists and slaps and pressed the neck of the informant when there is no injury on the neck of the informant. There is counter version of the occurrence also. A statement has been made in para 3 of the petition that the petitioners have no criminal antecedent.

It is submitted by learned counsel for the informant that injury has been found on the vital part of the body of the informant when opinion has been kept reserved and petitioners have also assaulted the informant.

Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Jehanabad in connection with Makhdumpur P.S. Case No. 183 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
