JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 24-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered under Sections-307, 379, 384 & other minor sections of the Indian Penal Code.

Petitioner is said to have assaulted the informant by means of Khukhari but submission on behalf of petitioner is that two cases were lodged against the prosecution party and the Superintendent of Police, supervised the aforesaid two cases including this case together and in all the cases, offences except Section-324 of the Indian Penal Code were found bailable in nature. It is further submitted that the Superintendent of Police mentioned the injury of the informant in his supervision note and the aforesaid observation goes to show that the informant

Patna High Court Cr.Misc. No.46466 of 2016 (2) dt.24-10-2016 2/2 sustained simple injuries though said to be caused by sharp cutting weapon.

Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Darpa P.S. Case No. 24 of 2016 to the satisfaction of learned Sub Divisional Judicial Magistrate, Raxaul at Motihari, East Champaran.
