The Petitioner who is in custody seeks bail in connection with Supplementory Jalalgarh P.S. Case No. 112 of 2015 registered for the offence punishable under Sections 147, 148, 149, 323, 307, 302, 504 and 427 of the Indian Penal Code.

It has been alleged in the FIR that the informant alongwith his two brothers were going on the motorcycle and when they reached near Jalkar village the motorcycle of Md. Sakib dashed their motorcycle, and thereafter some altercation took place between them and accused Md. Sakib hit on the head of the deceased on account of which he fell down on the road and sustained injuries and subsequently died.

Patna High Court Cr.Misc. No.38960 of 2017(2) dt.19-08-2017 2/2 It has been submitted on behalf of the petitioner that there is no specific allegation of any overt act against the petitioner. It has been further submitted that similarly situated co-accused person namely, Mustaque has been granted bail by a co-ordinate bench of this Court vide order dated 16.08.2016 passed in Criminal Miscellaneous No. 31252 of 2016. The petitioner has got no criminal antecedent and is in custody since, 18.07.2017.

Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial MagistrateVI, Purnea in connection with Supplementory Jalalgarh P.S. Case No. 112 of 2015.
