The petitioners are apprehending arrest in a case registered for the offences punishable under sections 147,148,149,323,324,307,379,504 and 506 of the Indian Penal Code and section 3(1)(x) of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act.

It is alleged against petitioner no. 1 Pintu Tiwari to have assaulted with farsa on the head of the informant whereas petitioner no. 2 Raki Tiwari assaulted on the head of the informant with the butt of country made pistol and abused by calling caste name.

No.36594 of 2015 (2) dt.10-09-2015 2/2 It is submitted by the learned counsel for the petitioners that in the background of 144 and 107 Cr.P.C. proceedings pending between the parties, the accusation has been levelled and there is counter version of the occurrence also. The aforesaid facts constitute ground for consideration of the prayer for regular bail of the petitioners by the learned court below in case the petitioners surrender within six weeks from today in connection with Nautan P.S. Case No. 65 of 2015 pending in the court of learned CJM, Siwan. This application is disposed of with the aforesaid observation/direction.
