The petitioner seeks regular bail in connection with Jhajha PS case no. 56 of 2005 registered for the offences punishable under Sections 149, 147, 302 of Indian Penal Code, Section 27 of Arms Act and Section 17 of CLA Act. It has been alleged that petitioner is not named in the FIR, which has been instituted against about 100 accused persons and subsequently, the name of the accused persons have surfaced during course of investigation, who are said to be belonging to MCC group. The allegation of the prosecution is that about 100 unknown criminals belonging to extremists group had killed the father of the informant.
Patna High Court Cr.Misc. No.30660 of 2017 (2) dt.06-07-2017 2/2 Learned counsel for the petitioner submits that similarly situated co-accused persons have already been granted bail by various orders which are annexed as Annexure-2 series to the bail petition and petitioner is in custody since 07.01.2017. Having regard to the facts and circumstances of the case, more particularly the fact that similarly situated co-accused persons have already been enlarged on bail, I deem it fit and appropriate to enlarge the petitioner on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of 2nd Addl. Sessions Judge, Jamui in connection with Jhajha PS case no. 56 of 2005. (Mohit Kumar Shah, J.) rinkee/- U T
