JUSTICE RAKESH KUMAR ORAL ORDER 22-10-2016 Heard Sri (Dr.) Amrendra Kumar, learned counsel, who was assisted by Sri Ravi Shanker Pankaj, learned counsel for the petitioner and learned Addl. Public Prosecutor. Two petitioners, who are in custody only since 27.07.2016 in Darpa P.S. Case No.32/2016 registered for the offence under Sections 147, 148, 149, 323, 324, 307, 386, 504, 506 of the Indian Penal Code and Section 27 of the Arms Act, have prayed for grant of bail, primarily on the ground that from both sides, cases were filed. By way of referring to Annexures 2 and 3 of the petition, learned counsel for the petitioners submits that from the petitioners' side, earlier case was filed against the informant of the present case and other persons. Patna High Court Cr.Misc. No.46296 of 2016 (2) dt.22-10-2016 2/2 recommended the case for bailable offence, whereas after going through the F.I.R., the Court is of the opinion that there is no ground to extend the privilege of bail since against both the petitioners, there is allegation that they gave Farsa blow on the head and injury was also received. Moreover, petitioner no.1 is having criminal antecedent and he is accused in number of cases Considering the nature of accusation, at the moment, I am not inclined to extend the privilege of bail. The petition stands dismissed.
