2. The petitioner is in custody since 20.02.2017 in connection with Gangabridge P.S. Case No. 18 of 2017 for the offences alleged under Sections 30(a) and 35(a) of the Bihar Prohibition and Excise Act, 2016.

3. It is submitted that the petitioner has been falsely implicated in connection with recovery of 1953 litres of foreign liquor from the container truck and in any event he has been sufficiently punished, having already suffered custody since 20.02.2017. The petitioner claims clean antecedents.

4. A perusal of the first information report, however, discloses that the petitioner accompanied the owner of the liquor, namely, Chhotan Rai on a motor-cycle for taking away the goods from the container truck which was meant for delivery to various liquor sellers for illegally marketing the goods.

5. Having regard to the nature of accusations and gravity of offence alleged and recovery of huge quantity of 1953 litres of
