Petitioner seeks bail in K. Hat(Sahayak) P.S. Case No. 126 of 2018 registered for the offence punishable under Sections 419, 420 and 379 of the Indian Penal Code. Informant in his written report has stated that in course of treatment of his wife he at about 1:30 pm went to ICICI bank ATM to withdraw money where one boy was already present in the ATM and when he could not withdraw money, the boy said I will help you and he took my ATM Card and exchanged it with another one and thereafter withdrew Rs. 40,000/-. Informant has further alleged that the boy thereafter purchased gold ornaments from jewellery shop worth Rs.
Patna High Court Cr.Misc. No.37709 of 2018(3) dt.05-09-2018 2/2 29,400/-.
It has been submitted on behalf of the petitioner that the photo of the petitioner is not in the CCTV footage of the Gold Shop. The name of the petitioner has been dragged in this case on the basis of information of a Spy of police. Petitioner has got no criminal antecedent and is in custody since 13.04.2018.
Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea, in connection with K. Hat(Sahayak) P.S. Case No. 126 of 2018.
