This is an application for bail in connection with Chiraiya P.S.Case No. 109 of 2016 registered under Sections 407, 468, 470, 420 of the IPC, Sections 103 & 104 of Trade Mark Act and under Sections 63, 64 and 65 of the Copy Right Act. It has been submitted on behalf of the petitioner is that in the seizure list neither there is signature of the petitioner nor his family members, as required under Section 100 of the Code of Criminal Procedure and, as a matter of fact, nothing has been recovered from the possession of the petitioner. It is further submitted that the petitioner has remained in jail for about four months and the petitioner has falsely been implicated in this case. Heard learned APP also.
Patna High Court Cr.Misc. No.54259 of 2016 (3) dt.28-01-2017 2/2 Learned APP has opposed the prayer for bail stating that huge quantity of wrapper of Dabur Company has been recovered from the possession of the petitioner. Having heard both sides and considering the fact that the petitioner is in jail for about four months, let the petitioner, Mufeed Ansari, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Sub-Divisional Judicial Magistrate, Sikarahana, Motihari, in connection with Chiraiya P.S.Case No. 109 of 2016, subject to the conditions that one of the bailors should be a local person having sufficient immoveable properties within the jurisdiction of the court concerned and further the petitioner will co-operate in the trial and make himself available in court on each and every date fixed and in the event of failure on his part to appear before the court on two consecutive dates, his bail bond shall be liable to be cancelled.
