Petitioner seeks regular bail in connection with Madanpur PS Case No. 87 of 2021 registered under Sections 25 (1-b)a / 26 / 35 of the Arms Act.

One live cartridge has been recovered from the possession of the petitioner.

Learned counsel for the petitioner submits that petitioner has got no criminal antecedent of similar nature of offence and from perusal of the seizure list it would be evident that at the time of seizure procedures prescribed under Section 100 of the Cr.P.C. has not been followed. He further submits that petitioner is in custody since 21-04-2021, charge sheet has already been submitted and there is no likelihood that the petitioner will abscond or tamper with the evidence, if released

Regard being had to the submissions made by the parties and taking into consideration the materials available on record, the fact that petitioner is in custody since 21/04/2021, charge sheet has already been submitted and there is no likelihood that the petitioner will abscond or tamper with the evidence if released on bail, as such, I am inclined to grant regular bail to the petitioner.

Let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 20000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Aurangabad in connection with Madanpur P.S Case No. 87 of 2021.
