JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-07-2017 The petitioners seek regular bail in connection with Kankarbagh P.S. Case No. 308 of 2013, registered for offences punishable under Section 302 of Indian Penal Code. It appears from record, the petitioner has earlier also moved this Court for grant of regular bail, which was rejected vide order dated 04.03.2017 passed in Criminal Miscellaneous No. 44253 of 2014 by a coordinate Bench of this Court. It has been submitted on behalf of the petitioner that in this case now almost all the witnesses including informant have been examined and they have been declared hostile as they have not supported the prosecution story. Further petitioner has been in languishing in judicial custody since 17.03.2017. Heard learned A.P.P. also.
Patna High Court Cr.Misc. No.31483 of 2017 (2) dt.13-07-2017 2/2 Having heard both sides, considering the facts and circumstances of the case and as the trial is at concluding stage, I am not inclined to release the petitioner on bail, his application for regular bail is, accordingly, rejected.
However, the trial court is directed to expedite the trial and try to conclude it within a period of four months and if the trial is not concluded within the aforesaid period, the petitioner will be at liberty to renew his prayer for bail in the court below itself, which will be considered by the court below on the basis of materials available on record.
