====================================================== CORAM: HONOURABLE MR. JUSTICE S. KUMAR ORAL ORDER 24-08-2018 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner, who is in custody, seeks bail in connection with Jehanabad P.S. Case No. 739 of 2017 registered for the offences punishable under Sections 302 and 201 of the Indian Penal Code.

Informant who is a Police Officer has stated in his written complaint that on 28.10.2017 at about 10:00 P.M. when he was on patrolling duty with other police personnels saw one Innova car on the road with some persons throwing away someone outside from the vehicle and after seeing the police party they fled away. It has been further stated that after killing criminals threw away him from the vehicle.

It has been submitted by learned counsel for

Patna High Court Cr.Misc. No.38367 of 2018(3) dt.24-08-2018 2/2 petitioner that he is innocent and falsely been implicated in this case only on suspicion. He is not named in FIR and no incriminating material has been found against the petitioner. He is in custody since 02.02.2018. It has been further submitted that one similarly place co-accused Rayees Yadav has been granted bail by a co-ordinate Bench of this Court in Cr. Misc. No. 24079 of 2018 vide order dated 24.05.2018.

Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Shri Ramayan Rai learned C.J.M., Jehanabad in connection with Jehanabad P.S. Case No. 739 of 2017.
