Petitioner seeks bail in a case registered for the offences punishable under Sections 364, 307, 379/34 of the Indian Penal Code.
It appears that co-accused, Karku Yadav, who was refused bail by the impugned order has already been granted bail by a co-ordinate Bench of this Court passed in Criminal Miscellaneous No.42332 of 2018, considering the fact that allegation of kidnapping was against co-accused, Gaurav Goswami and Rahul Sah and allegation of commission of injury with knife was against Kundan Yadav.
Since allegation against the petitioner is similar to co-accused, Karku Yadav, hence, let the petitioner, above
Patna High Court Cr.Misc. No.36454 of 2018(3) dt.27-08-2018 2/2 named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned court below where the case is pending in connection with Mojahidpur (Babbargunj) Police Station Case No.03 of 2018, subject to condition that both the bailors shall be resident of within the territorial jurisdiction of the learned court below and the petitioner shall fully co-operate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
