The petitioner apprehends his arrest in Excise Case No.48 of 2019-20 for the offence allegedly committed by the petitioner under Section 30(a) of the Bihar prohibition and Excise Act.

The informant, Excise Official, got information about the keeping of liquor in the house of Ranvijay Yadav and on such raid was conducted. 87 litres of liquor of different brands was recovered from the house of the petitioner. Learned counsel for the petitioner submits that the deed of the house is standing in the name of mother of the petitioner. The mother of the petitioner sold the house in the year 2010 and the petitioner filed petition for disconnection of

Merely an agreement is filed showing the transfer of the land and house. The excise official after getting information that it was the petitioner who had kept liquor in his house, raided the house from which huge quantity of liquor was recovered.

Taking into consideration the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the prayer for anticipatory bail of the petitioner is rejected.
