Petitioner seeks bail in a case registered for the offences punishable under Sections 392, 394 and 411 of the Indian Penal Code.
The petitioner was apprehended by the people at the spot when along with others including another apprehended person Mithilesh Kumar, the petitioner was robbing the informant after bitterly assaulting him. The petitioner is in custody since 23.03.2018.
Considering the nature of allegation, I am not inclined to enlarge the petitioner on bail at this stage in connection with Sonepur/Hajipur Rail Police Station Case No. 23 of 2018 pending in the court of learned Additional Chief Judicial
Patna High Court Cr.Misc. No.36549 of 2018 (3) dt.27-08-2018 2/2 Magistrate (Railway), Sonepur (Saran). However, the petitioner may renew his prayer for bail after completion of one year of custody, if the trial before the court below does not progress in the meantime.
Learned trial court is directed to expedite the trial.
