JUSTICE ANIL KUMAR SINHA ORAL ORDER 08-04-2022 Heard Mr. Pankaj Kumar Sinha, learned counsel for the petitioner and Mr. Khurshid Anwar, learned Additional Public Prosecutor for the State through video conferencing. Petitioner seeks regular bail in connection with Chakai PS Case No. 57/2016 registered for the offence punishable under Sections 16, 17, 18, 19, 20, 21, 22 of the UAP Act of the IPC.

As per First Information Report, the husband of the informant was taken away from his house by the petitioner and other co-accused persons and he was kept in a hut of one Teju Mandal where two persons were already there from before and it has been alleged that all the three persons have been killed by the accused persons by slitting their throats. Learned counsel for the petitioner submits that the petitioner is in custody since 25.12.2020 and the charge-sheet has already been submitted. Having regards to the submissions made by the parties and taking into consideration the material on record and the fact that similarly situated co-accused persons have been granted bail by Co-ordinate Benches of this Court vide Annexure-2, petitioner having no criminal antecedent is in custody since 25.12.2020, I am inclined to grant regular bail to the petitioner subject to the conditions that (1) both the bailors shall be residents of the territorial jurisdiction of the court concerned and

(2) the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

Accordingly, let the petitioner, SURESH TURI be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate- 5th , Jamui/the court concerned in connection with Chakai PS Case No. 57/2016.
