JUSTICE DINESH KUMAR SINGH ORAL ORDER 11-09-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341,323 and 504 of the Indian Penal Code and section 3(1)(x) of the Scheduled Caste and Scheduled Tribe (Prevention of Atrocities) Act. The prosecution case is that the Police Inspector of Jhanjharpur police station came for enquiry with regard to a case lodged by petitioner no. 1 against the informant then the informant went to the door of the petitioners to inquire about the case when he was abused and assaulted.
It is submitted by the learned counsel for the petitioners
Patna High Court Cr.Misc. No.36807 of 2015 (2) dt.11-09-2015 2/2 that as a retaliatory measure the present case has been lodged and petitioner no. 1 lodged Andhrathari P.S. Case No. 8 of 2015 on 17.1.2015 and thereafter the present case has been lodged on 7.2.2015 for the occurrence of 1.2.2015.
Considering the delayed lodging of the case and the case lodged by the petitioner no. 1 at earlier point of time, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned ACJM, Jhanjharpur, Madhubani in connection with Madhubani SC/ST P.S. Case No.8 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
