JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 06-10-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. 122 bottles Indian made foreign liquor were recovered from a tempo, which was being driven by co-accused Ajeet Singh, and at the time of aforesaid recovery, one person managed to flee away from the place of occurrence.

Submission on behalf of the petitioner is that as a matter of fact, petitioner was simply passenger of the tempo. It is also submitted that tempo driver, namely, Ajeet Singh as well as one co-accused Uday Singh have already been granted privilege of bail by different Benches of this Court Accordingly, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two
