Petitioners seek bail in a case registered under sections 414, 413/34 of the Indian Penal Code.

Neither petitioners were caught on the spot nor anything was recovered from their conscious possession. No doubt, petitioners do carry criminal antecedent but they are languishing in jail custody since 6.8.2016 and 25.7.2016 respectively and in the present case except confessional statement of co- accused, there appears to be nothing against them. Accordingly, petitioners are directed to be released on bail on furnishing bail bonds of Rs 10,000/- each with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate I, East Champaran at Motihari in Dumariaghat P.S. Case no. 64/2016.
