Petitioner seeks regular bail in connection with Phulwaria P.S. Case No.60 of 2017 registered for the alleged offences under Sections 387 and 307/34 of the Indian Penal Code. As per the prosecution case, Munshi of Sita Ram Poddar was injured by hurling bomb upon him for not coughing up demand of extortion made by co-accused, Rajeev Yadav and Parshuram Mahto by his owner.
It has been submitted by learned counsel for the petitioner that the petitioner is not named in the F.I.R. He is simply said to have escaped from the place of occurrence at the time of incident. No one had seen him hurling bomb or demanding any extortion. It is the natural course of conduct that after
Patna High Court Cr.Misc. No.32423 of 2017 (02) dt.13-07-2017 2/2 explosion of bomb persons would escape from the vicinity of the place of occurrence. Petitioner has no criminal antecedent. He has been languishing in jail custody since 21.05.2017. In the facts and circumstances of the case, the petitioner above named is directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of like amount each to the satisfaction of learned Judicial Magistrate 1st Class, Begusarai in connection with Phulwaria P.S. Case No.60 of 2017.
