The petitioner being the husband of the complainant is apprehending his arrest in a complaint case wherein processes have been directed to be issued after cognizance being taken for the offences punishable under
Patna High Court Cr.Misc. No.37809 of 2015 (04) dt.07-12-2015 2/3 Sections 498A/34 of the Indian Penal Code and 3/4 of Dowry Prohibition Act.
The basic accusation is of torture for nonfulfillment of the dowry demand. It is submitted by learned counsel for the petitioner that both sides have decided to part ways on payment of permanent alimony on dissolution of the marriage. Counsel for the complainant is not controverting the contentions of the counsel for the petitioner. It is submitted that both sides have filed joint affidavit. It is agreed between the parties to file application before the learned court below under Section 13B of the Hindu Marriage Act for dissolution of the marriage. It is expected from both the courts below to proceed in matrimonial suit as well as present complaint case in accordance with law in view of the compromise arrived at between the parties and dispose of the same expeditiously.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like
Patna High Court Cr.Misc. No.37809 of 2015 (04) dt.07-12-2015 3/3 amount each to the satisfaction of learned Sub-divisional Judicial Magistrate, Sheikhpura in connection with Complaint Case No. 53C of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
