ANJANA PRAKASH ORAL JUDGMENT Date: 29-01-2016 The Petitioner seeks quashing of the order of cognizance dated 8.7.2010 passed by the court of Shri Ranjeet Prasad, Judicial Magistrate, 1st class, Khagariya in Complaint case No.57 of 2010. The case of the Complainant is that her daughter was taken to the Sadar Hospital, Khagariya, where she gave birth to a female child in the corridor but she was not admitted. When she made complaints, she was abused and assaulted.

It has been submitted on behalf of the Petitioner that it was on account of heavy rush in the Hospital that the patient could not be admitted but was duly attended. On being aggrieved with the shortage of beds the present Complaint was filed without any reasonable cause.

No.30224 of 2010 dt.29-01-2016 2/2 Having considered the aforesaid, the application is allowed and the proceeding including the order of cognizance dated 8.7.2010 passed by the court of Shri Ranjeet Prasad, Judicial Magistrate, 1st class, Khagariya in Complaint case No.57 of 2010 is hereby set aside.
