====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR SINHA ORAL ORDER 08-04-2022 Heard Mr. Suraj Kumar, learned counsel for the petitioner and Mr. Parmeshwar Mehta, learned Additional Public Prosecutor appearing for the State through video conferencing.

Petitioner seeks regular bail in connection with Barh P.S. Case No. 82/2021 registered for the offences punishable under Sections 420, 467, 468 and 476 of the Indian Penal Code 1860.

As per the prosecution story, one Dilip Das was selected for the PDS dealer and the allegation is that the certificate of educational qualification submitted by the selected candidate Dilip Das was fake and was not issued by the authorized institution.

Learned counsel for the petitioner submits that the

No.50989 of 2021(2) dt.08-04-2022 2/2 petitioner has falsely been implicated in this case merely on the basis of statement of wife of co-accused Dilip Das, namely, Nirmala Devi. Learned counsel further submits that the petitioner is neither signing nor issuing authority of the said certificate and he is in custody since 8.6.2021. He next submits that charge sheet has already been submitted and there is no likelihood that the petitioner will abscond or tamper with the evidence.

Regards being had to the submission made by the parties and taking into consideration the materials on record, the fact that the petitioner is in custody since 8.6.2021 and charge sheet has already been submitted, I am inclined to grant regular bail to the petitioner.

Accordingly, let the petitioner, above named, be released on regular bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-1st, Barh, Patna, in connection with Barh P.S.
