The petitioner has prayed for bail in connection with Excise P.S. Case No. 311 of 2019 registered for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution report, in course of raid total 25 litres of toddy, kept in a plastic gallon, was recovered from possession of the petitioner.

It is submitted by the learned counsel for the petitioner that allegations, as made in the prosecution report, against the petitioner, are incorrect. He has no criminal antecedent and he is in custody since 31.05.2019.

No.38109 of 2019(2) dt.05-07-2019 2/2 Having heard the learned counsel for the parties and considering the nature of allegation, the fact that the petitioner is in custody since 31.05.2019 and has no criminal antecedent, this Court is inclined to grant bail to the petitioner. The above named petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Special Excise Judge, Gaya in connection with Excise P.S.
