The petitioners are apprehending arrest in a case registered for the offences punishable under sections 272, 273 of the Indian Penal Code and 47a of the Excise Act. The prosecution case is that from the bamboo-clump of petitioner no.2 namely Manoj Sahani 25 litres country made liquor, two manufacturing machines and several empty plastic drums were recovered.

It is submitted by learned counsel for the petitioners that from the accusation it appears that recovery has not been made from the petitioners. Moreover, statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.

The aforesaid facts constitute ground for

Patna High Court Cr.Misc. No.37879 of 2015 (2) dt.21-09-2015 2/2 consideration of prayer for regular bail. Let the learned Court below consider the prayer for regular bail of the petitioners, if the petitioners surrender within a period of six weeks in connection with Muffasil (Lakhaura) P.S. Case No.143 of 2015, pending before the learned SDJM, Sadar, Motihari. With the above observation, this application is, accordingly, disposed off.
