The petitioner apprehends her arrest in a case registered for the offences punishable under Section 307 and other Sections of the Indian Penal Code.

The petitioner is alleged to have assaulted the informant Nilam Devi and thereafter Niwash Yadav, husband of the petitioner is alleged to have assaulted the informant with a piece of brick causing injury on her head.

It is submitted that the husband of the petitioner has already been granted regular bail. The case of the petitioner stands on better footing. She is a lady. The injury found on the person of the injured is simple in nature.

Considering the facts aforesaid and the fact that the

No.36781 of 2015 (4) dt.15-12-2015 2/2 husband of the informant has already been enlarged on bail, the petitioner above named is directed to surrender within four weeks in the court below and the learned court below shall consider the prayer for regular bail of the petitioner, taking into consideration that the husband of the petitioner who is alleged to have assaulted with piece of brick, has already been enlarged on bail and dispose of the bail petition preferably on the same day. With the aforesaid observations, the anticipatory bail petition is disposed of.
