JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-08-2017 The petitioner seeks regular bail in connection with Bairiya P.S. Case No. 121 of 2017, registered for offences punishable under Sections 376/ 511 of Indian Penal Code. Allegation against the petitioner is of attempting to commit rape on the informant.

It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and for the dispute over petty things he has falsely been implicated in this case and is aged about sixty years. Further he has been in judicial custody since 19.05.2017.

Learned counsel for the State opposed the prayer for bail and submitted that there is direct allegation against the petitioner. Having heard both sides, considering the fact and

Patna High Court Cr.Misc. No.34806 of 2017 (2) dt.03-08-2017 circumstances of the case and nature of allegation, I am not inclined to release the petitioner on bail, his application for regular bail is, accordingly, rejected.

However, the petitioner may renew his prayer for bail after framing of charge in this case.
