JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 29-11-2022 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in a case registered for the offence punishable under sections 302, 304B/34 of the Indian Penal Code.

It is a case of dowry death.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. There is general and omnibus allegation against the petitioner and no specific overt act has been alleged against him, who happens to be married nanad of the deceased. It is further submitted that the petitioner is separate in mess and business. Thrust of allegation is against the husband of the deceased who is already in custody.

Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks

Patna High Court CR. MISC. No.42353 of 2022(2) dt.29-11-2022 2/2 from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, West Champaran, Bagaha in Chautarwa Police Station Case No. 5 of 2022, subject to the conditions laid down under section 438 of the Code of Criminal Procedure.
