=========================================================== CORAM: HONOURABLE MR. JUSTICE AHSANUDDIN AMANULLAH ORAL JUDGMENT Date: 03-09-2015 Heard learned counsel for the petitioner. Nobody appears on behalf of respondents.
Learned counsel for the petitioner submits that as of now the only grievance which the petitioner has relates to payment of interest on G.P.F. which has been paid till 28.03.2000, though such payment was made in the year 2010.
Patna High Court CWJC No.20958 of 2011 dt.03-09-2015 2/2 From the counter affidavit filed on behalf of respondents on 28.10.2013 at paragraph-10, it is admitted that interest was paid upto the date of dismissal, that is, 28.03.2000. The Court finds that the petitioner is entitled to statutory interest on the delayed payment of G.P.F.
Accordingly, the writ petition stands disposed off with a direction to the respondent no. 5 to ensure payment of statutory interest on G.P.F. from the date of dismissal of the petitioner in the year 2000 till the date of actual payment in the year 2010. Such payment be made within four weeks from the date of production of a copy of this order upon the respondent no. 5, failing which the rate of interest shall be @ 12% simple interest per annum which would be recoverable from the officer causing delay in such payment.
