The petitioner apprehends his arrest in Kishanganj P.S. Case No. 35 of 2010, registered for the offence punishable under Section 379 of the Indian Penal Code.
The case is lodged against unknown for theft of motorcycle bearing Registration No. BR-11D/5101. The petitioner is not named in the FIR.
It is submitted that the name of the petitioner figured in the case in the confessional statement of co-accused, but it appears that during the course of investigation many witnesses have stated that the petitioner and other accused persons were found taking the motorcycle.
Considering the facts aforesaid, I am not inclined to
Patna High Court Cr.Misc. No.51274 of 2014 (3) dt.24-06-2015 2/2 enlarge the petitioner above named on anticipatory bail. Accordingly, the same is rejected.
