Heard learned counsel for the petitioner.

This is an application for bail in connection with Matihani P.S. Case No. 119 of 2017 registered for the offences punishable under Section 30(A) of Bihar Prohibition and Excise Act, 2016.

Allegation against the petitioner is of recovery of 68 litres of foreign liquor from his field.

Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and seizure list was prepared on 21.7.2017 in which signature of petitioner was there

Patna High Court Cr.Misc. No.46549 of 2017 (2) dt.20-09-2017 2/2 but petitioner was arrested on 22.7.2017, which falsifies the prosecution case. Further submission is that though he is made accused in one more case but he has been granted anticipatory bail in that case.

Heard learned APP also.

Having heard both sides and in view of facts and circumstances, this application is disposed of with a direction to the court below that once charge has been framed in this case or petitioner completes four months period in judicial custody, whichever is earlier, he will be released on bail to its own satisfaction, if an application for bail is filed on behalf of petitioner.
