The petitioner has preferred this application for grant of regular bail in a case registered under sections 307, 147, 148, 149, 341, 342, 323, 324, 325 and 326 of the Indian Penal Code. As per the prosecution case, the petitioner and two others are said to have resorted to firing as a result of which Mannu Yadav, Moti Yadav and Tuntun Yadav sustained injuries and fell down on the ground. Thereafter all the accused persons are said to have assaulted the informant and others. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. The allegations as levelled in the FIR are falsified from the contents of the injury reports of the aforesaid Mannu Yadav, Moti Yadav and Tuntun Yadav from which it would transpire that as against

The petitioner is in custody since 5.6.2021 and investigation in the case has been completed. The petitioner has no criminal antecedent. Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the submissions made on behalf of the petitioner together with the material that has transpired in course of investigation specially the injury reports and investigation in the case having concluded, the Court directs the petitioner to be enlarged on bail in connection with Bounsi P.S. Case no. 72 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka.
