JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 06-07-2017 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners are in custody since 26.10.2016 in connection with Arwal P.S. Case No. 48 of 2016 registered for the offence punishable under section 379 of the Indian Penal Code.

The Police, after investigation, submitted the charge sheet and in paragraph 7 of this petition, there is a statement that co-accused Mantu Kumar @ Saras Yadav @ Saras Kumar has already been granted bail by this Court in Cr. Misc. No. 17413 of 2017 vide order dated 26.04.2017 and co-accused Nehal Kumar

Patna High Court Cr.Misc. No.27446 of 2017 (2) dt.06-07-2017 2/2 has also been granted bail by this Court in Cr. Misc. No. 23427 of 2017 vide order dated 18.05.2017.

Having regard to the parity of the case of the petitioners with the cases of co-accused who have already been granted bail and also the fact that the petitioner has remained in custody since 26.10.2016, let the petitioners, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Arwal or Successor Court in connection with Arwal P.S. Case No. 48 of 2016, subject to the condition that the petitioners will extend full cooperation in conclusion of the trial and they will not, in any manner, tamper with the evidence and influence the witnesses.
