JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 25-11-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is said to have given repeated farsa blow causing head injury to Sailesh Tiwary. So far as rest injured are concerned, they were, allegedly, assaulted by other co-accused. The occurrence is said to have taken place on account of cutting of bamboo tree. The injured Sailesh Tiwary appears to have sustained altogether four injuries on his head which is evident from preliminary injury report of the aforesaid injured. However, para- 49 of the case diary goes to show that the aforesaid injuries of the injured Sailesh Tiwary were found simple in nature said to be caused by hard and blunt substance.
Considering the period of detention of the petitioner
Patna High Court Cr.Misc. No.42550 of 2016 (3) dt.25-11-2016 2/2 in jail custody since 22.07.2016, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Siwan in connection with Bhagwanpur P.S.Case No. 111 of 2016.
