2. The petitioner apprehends her arrest in a case registered for the offences punishable under Sections 272, 273/34 of the Indian Penal Code and sections 30(a), 36 and 41(i) of the Bihar Prohibition & Excise Act, 2016.

3. Total 2160 litres of liquor was recovered from a truck and driver was apprehended on the spot.

4. It is submitted that name of petitioner transpired in this case on the basis of confessional statement of co-accused. Petitioner is neither driver nor owner of vehicle in question and she has got no concern with the seized liquor. The only material against this petitioner is that in her bank account Rs. 49,000/- has been received from account number of one of liquor syndicate.

5. Counsel for State however, vehemently opposed the prayer for bail and submitted that petitioner has got criminal antecedent of similar nature.

6. Considering the facts aforesaid and criminal antecedent of similar nature, I am not inclined to enlarge the petitioner above-named on anticipatory bail in connection with Malaypur P.S. Case No. 57 of 2021. Accordingly, the same is rejected.
