JUSTICE JYOTI SARAN ORAL ORDER 07-08-2015 Heard Mr. Ranjan Kumar Dubey, learned counsel appearing on behalf of the petitioner, learned counsel for the State and Mr. Vijay Shankar Upadhyay, learned counsel appearing for the Nagar Parishad, Sasaram.

The petitioner prays for a direction to the authorities of the Nagar Parishad, Sasaram to re-construct the drain situated in Ward No.33 at Holding no.485 to 483 in Mohalla- Bagbhai Kuan, Noorganj in the district of Rohtas at Sasaram. The complaint of the petitioner is that the drain has not been properly constructed and as a result the water is overflowing and is resulting in accumulation of drain water in front of the house of the petitioner. Taking note of the nature of grievance raised in the writ petition and considering that an application has been filed by the petitioner before the Executive Officer, Nagar Parishad, Sasaram drawing his attention, this writ petition is disposed of with a direction to the Executive Officer, Nagar Parishad, Sasaram to consider the complaint of the petitioner as reflected in his representation present at Annexure-1 and dispose of the same in accordance with law and after opportunity of hearing to the petitioner expeditiously and preferably within a period of three months from the date of receipt/production of a copy of this order.
