JUSTICE SANJAY PRIYA ORAL ORDER 07-09-2017 Heard learned counsel for the petitioner and the State. The petitioner apprehends his arrest in Ara Nawada P.S. Case No. 265 of 2015 instituted for the offence under Sections 147, 148, 149, 342, 302, 506 of the Indian Penal Code and Section 27 of the Arms Act.

In the written report there is specific allegation against the petitioner that he fired shot from the pistol in the stomach of brother of the informant, on account of which, he fell down on the ground. It is further alleged that other co-accused persons as named in the First Information Report also fired shot on the person of the brother of the informant due to which he died on the spot.

In such circumstances, this Court is not inclined to

Patna High Court Cr.Misc. No.41296 of 2017 (2) dt.07-09-2017 2/2 grant anticipatory bail to the petitioner.

Prayer for anticipatory bail of the petitioner stands rejected.
