The petitioner seeks bail in anticipation of his arrest in connection with Phulparas P.S. Case No. 442 of 2019, dated 19.10.2019, instituted for the offences under Sections 341, 323, 354(B), 379 and 504/34 of the Indian Penal Code.

The accusation against the petitioner is of having tried to outrage the modesty of a minor girl. The learned counsel for the petitioner has

Patna High Court CR. MISC. No.38065 of 2020(2) dt.16-04-2021 2/2 submitted that the F.I.R. has been lodged after a delay of five days and it is only a counter blast to the case lodged by the father of the petitioner against the informant of the present case.

Notwithstanding the facts afore-stated, I am not inclined to grant anticipatory bail to the petitioner on the accusation made in the F.I.R. and what has been gathered during the course of investigation which appears from the impugned order.

The prayer for grant of anticipatory bail of the petitioner is, accordingly, rejected.

However, if the petitioner surrenders before the Court below and seeks bail, the Court below shall consider the case on its own merits, without being prejudiced by the fact that the present anticipatory bail application has not been entertained by this Court.
