The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code and section 27 of the Arms Act. As per the prosecution case, 08 named accused persons including petitioners made indiscriminate firing as a result of which informant's father sustained injury and died during course of treatment.

It is submitted that informant is not eye-witness of the occurrence. As per the FIR, it was co-accused Imteyaz and Amir Khan shot dead the father of informant. No specific overt act

Patna High Court CR. MISC. No.41996 of 2022(4) dt.06-12-2022 2/2 has been alleged against petitioners. The doctor found only one wound of entry and another one wound of exit on the person of deceased.

Counsel for informant vehemently opposed the prayer for bail.

Considering the facts aforesaid, the petitioners abovenamed, in the event of their arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate XV, Gopalganj in connection with Mirganj P.S. Case No. 15 of 2022, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
