Petitioner, Ankit Anand, is in custody since 09.06.2016 in East Colony (Jamalpur) P.S. Case No. 32 of 2016 registered under Section 393 of the Indian Penal Code.

According to prosecution case, the informant lodged F.I.R. alleging that two unknown persons tried to loot Rs. 30,000/- from him while he was coming out from the Bank withdrawing the same amount but they failed. However, while fleeing away, the informant noted the number of the motorcycle on which they fled away. Subsequently, other accused person, namely, Neeraj Kumar and this petitioner have been arrested.

Learned counsel for the petitioner submitted that motorcycle is registered in the name of Pankaj Kumar, who is not an accused. Nothing has been recovered from the possession of the

Considering the above facts and circumstances of the case that attempt was made but it was failed and that the motorcycle is in the name of one Pankaj Kumar, who is not an accused in this case, I direct the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand rupees only) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Munger in connection with Eat Colony (Jamalpur) P.S. Case No. 32 of 2016.
