The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 395, 412 of the Indian Penal Code.

The prosecution case is that four miscreants with pistol surrounded the vehicle which was loaded with rice and after entering into the cabin of the truck compelled the driver and cleaner to get down from the vehicle and one of the miscreants took out Rs.1,000/- from the pocket of the informant, but in the meantime patrolling jeep of Khaira Police Station came, when the miscreants started fleeing away, but on chase two were caught, who disclosed their names as Gobind Mishra and Kumud Sah and Gobind Mischra disclosed the name of the other

Patna High Court Cr.Misc. No.37910 of 2015 (2) dt.18-09-2015 miscreants including the petitioner.

It is submitted by the learned counsel for the petitioner that except the confession of the co-accused nothing has been collected against the petitioner. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent and similarly situated co-accused Jitendra Mishra @ Jitendra Kumar Mishra has been granted bail vide Cr. Misc. No. 51498 of 2014.

Considering the aforesaid facts, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sri U.K. Pandey, Judicial Magistrate, Ist Class, Jamui in connection with Khaira P.S. Case No. 193 of 2014, subject to conditions as laid down under Section 438(2) of the Indian Penal Code.
