JUSTICE BIRENDRA KUMAR ORAL ORDER 20-12-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 272/273 of the Indian Penal Code and Section 47/57 of the Bihar Excise (Amendment) Act, 2016.

Forty-six bottles of foreign liquor was recovered from the motorcycle of this petitioner on 16.07.2016. Submission is that possession of foreign liquor was not an offence on the alleged date of recovery. Co-accused Dhanjee Patel has already been allowed bail in Cr. Misc. No.44298 of 2016 on 05.10.2016 by a coordinate Bench of this Court.

No.48164 of 2016 (2) dt.20-12-2016 2/2 Considering the aforesaid facts, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara/Successor Court, in connection with Barahara (Sinha) P.S. Case No. 240of 2016.
