20-07-2017 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor.
On account of grudge, it has been alleged by the informant Sk. Enamul that while he along with his brother Sk. Anwarul (deceased) were returning from Sariswa Bazar on 07.03.2017 at about 06:00 PM, they met with Sk.Bolar and Sk. Matlub who were coming from opposite side who, seeking them intended to kill and during course thereof, they fired as a result of which, his brother sustained injury over his back and fell down. The aforesaid two persons were joined by Sk. Buchai, Sk. Tulai, Sk. Kari along with 3-4 unknown persons who caught hold his brother Sk. Anwarul and then Sk. Buchai shot at over head of his brother on an order of Sk. Kari. An attempt was also made over him but he anyhow, escaped. He also smack foul play at the end of Sk. Yakub as well as Sk. Jainul. Both petitioners are not named in the FIR. From the lower court record, it is apparent that both the petitioners were apprehended relating to Majhaulia P.S.Case No.86/2017 and during
Patna High Court Cr.Misc. No.34052 of 2017 (2) dt.20-07-2017 course of interrogation relating thereto, also confessed regarding their participation in the present case.
That being so, petitioners Sadam Hussain @ Saddam Hussain, Sajid Ansari @ Guddu Ansari @ Guddu each are directed to be released on bail on furnishing bail bonds of Rs.10,000/-(ten thousand) with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Majhaulia P.S. Case No.73/2017.
