The petitioner is apprehending his arrest in connection with Mahila P.S.Case No.16 of 2018 corresponding to G.R.No.557 of 2018 , registered for offences punishable under Sections 498(A), 323, 341, 34 of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act..

Prosecution story as per interim report is that the petitioner who happens to be husband of the informant and other accused persons after marriage started demanding Rs.02 lac and one motorcycle and on non-fulfilment of demand, they abused and snatched the ornaments and ousted her from the house.

Submission of the learned counsel for the petitioner is that no specific allegation has been attributed against the petitioner and he is still ready to keep her but in spite of notice

Heard learned A.P.P. , who has opposed the prayer for bail..

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Sheohar in connection with Mahila P.S.Case No.16 of 2018 subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure with condition that if the O.P.no.2 is still ready to reside with the petitioner, the petitioner will keep her with dignity and care. .

With the aforesaid direction, this application is allowed.
